Introduction

This Terms of Use (this “Agreement”) is an agreement between you and Arya Marketplace Limited, including but not limited to legal persons, unincorporated organizations that provide Arya Marketplace Services.

This Terms of Use governs your use of all Arya Marketplace Services.These general terms and conditions shall apply to buyers and sellers on the marketplace and shall govern your use of the marketplace and related services. You unconditionally accept and agree to be bound by the terms and conditions set out in this Terms of Use including the Privacy Policy as well any applicable laws and guidelines when you access the Arya Marketplace Platform or use any of the Arya Marketplace Services. If you disagree with any part hereof, kindly desist from using the Arya Marketplace Platform or any of the Arya Marketplace Services. You should read all of these terms carefully.

‌Our services

Arya Marketplaceis the trading name for the Arya Marketplace Limited e-commerce platform consisting of a website and mobile application (“marketplace”) together with supporting IT logistics and payment infrastructure for the sale and purchase of consumer products and services (“products”) in its allocated territory.
Arya Marketplace provides an online location for sellers to sell and buyers to purchase products;
Arya Marketplaceaccepts binding sales on behalf of sellers but (unless Arya Marketplace is indicated as the seller) Arya Marketplace is not a party to the transaction between the seller and the buyer;
A contract for the sale and purchase of a product or products will come into force between the buyer and seller and accordingly you commit to buying or selling the relevant product or products upon the buyer’s confirmation of purchase via the marketplace.
Arya Marketplace is an E-commerce services provider that provides online shopping platforms, stores and similar activities with displaying their products
The platform contains a variety of sellers, products, brands and stores you can choose to order your preferred items from and have them delivered to you.
This Platform allows for selling and buying of variety of items.
With Arya Marketplace mobile app, customers can view the product with information for each item, allowing users to make informed choices, and customers can place order directly from their devices. Orders are then sent fordelivery. Customers are able to pay online via card, with cash or POS systems.
Arya Marketplace may not be affiliated or have any form of partnerships with these sellers.
We operate the Platform and implement the tools and technical means to enable this relationship to work smoothly. We do not have possession of any item offered for sale. Arya Marketplaceis not a part or subsidiary of any of the sellers listed on this platform.
We have no control over and do not guarantee the existence, quality and safety of items advertised. We do not guarantee the truth or accuracy of sellers offers and the ability of seller to sell items as described.
We cannot give any undertaking that items ordered through this Platform will be of satisfactory quality and, this and any other such warranties (whether express or implied) are disclaimed by us to the fullest extent permitted by law.

‌General Terms and Conditions of Use of the Arya Marketplace Solution for Buyers and Sellers

By using Arya Marketplace, you accept these general terms and conditions in full. If you disagree with these general terms and conditions or any part of these general terms and conditions you should not use this platform or service.
This term of use becomes effective from the date you start using our services and continues until it is terminated by either you (through the closing of your account) or us.
If you use our Arya Marketplace in the course of a business or other organizational project then by so doing you:
1. Confirm that you have obtained the necessary authority to agree to these general terms and conditions;
2. bind both yourself and the person, company, or other legal entity that operates that business or organizational project to these general terms and conditions; and
3. agree that you in these general terms and conditions shall reference both the individual user and the relevant person, company or legal entity unless the context requires otherwise.
4. Subject to these general terms and conditions the seller’s terms of business shall govern the contract for sale and purchase between the buyer and the seller. Notwithstanding this the following provisions will be incorporated into the contract of sale and purchase between the buyer and the seller:
  1. the price for a product will be as stated in the relevant product listing;
  2. the price for the product must include all taxes and comply with applicable laws in force from time to time;
  3. delivery charges packaging charges handling charges administrative charges insurance costs other ancillary costs and charges where applicable will only be payable by the buyer if this is expressly and clearly stated in the product listing; and delivery of digital products may be made electronically;
  4. In cases where a Buyer requires customized items and initiates a Request for Proposal (RFP), the Seller will respond with a proposal that includes pricing and other applicable terms. For such RFP-based transactions, charges such as delivery, packaging, handling, administrative fees, insurance, and any other ancillary costs are not listed on the standard product listing and will only be payable by the Buyer if these charges are expressly and clearly outlined in the Seller’s proposal and agreed upon by both parties. Delivery of digital products, where applicable, may be made electronically.
  5. products must be of satisfactory quality fit and safe for any purpose specified in and conform in all material respects to the product listing and any other description of the products supplied or made available by the seller to the buyer;
  6. in respect of physical products sold the seller warrants that the seller has good title to and is the sole legal and beneficial owner of the products and/or has the right to supply the products pursuant to this agreement and that the products are not subject

to any third party rights or restrictions including in respect of third party intellectual property rights and/or any criminal insolvency or tax investigation or proceedings; and in respect of digital products the seller warrants that the seller has the right to supply the digital products to the buyer.

‌Terms and Conditions:

Arya Marketplace is not responsible for any disagreement or conflict that occurs between the customer and the Service Provider.
The service provider bears full responsibility for his account, the content in his account and the lists created by him in Arya Marketplace.
Arya Marketplace is obligated to license the system for non-exclusive use during the customer’s subscription period for the paid period.
Arya Marketplace has the right to terminate and stop the service if the service provider is misusing the platform.
Arya Marketplace reserves the right to amend or replace any of the conditions or clauses mentioned on this page, or to change, suspend or suspend the service or platform (including but not limited to providing any feature or content) in at any time, by notification on the site, via e-mail, or any other communication method. Arya Marketplace may also place restrictions on certain features and services or limit your access to parts of the service or the entire service without notice or liability.
It is the responsibility of customers to review this page periodically if there is updated information as they will be binding on you. If you are an existing user, we will notify you via email about changes.
Arya Marketplace is not a party to the transaction between the seller and the buyer. A contract for the sale and purchase of a product will come into force between the buyer and seller upon the buyer’s confirmation of purchase via the Arya Marketplace.
Subject to these general terms and conditions, the seller’s terms of business shall govern the contract for sale and purchase between the buyer and the seller. Notwithstanding this, the following provisions will be incorporated into the contract of sale and purchase between the buyer and the seller:

‌Eligibility

To be eligible to use or access the Arya Marketplace, the following conditions must be met by you:

You must create aArya Marketplace user account on Arya Marketplace App;
as an individual, be at least 18 or be of legal age to form a binding contract under applicable laws
as an individual, legal person, or other organization, you have full power, authority and capacity to accept these Terms of Use;
as an employee or agent of a legal entity, you must have the full power, authority and capacity to accept these Terms of Use on their behalf and bind such legal entity to these Terms of Use;
you have not been previously restricted from using or accessing the Arya Marketplace. If your account has already been disabled and you have been banned from using the system you are not allowed to use the Arya Marketplaceplatform
If you are a competitor or offer any product that competes with Arya Marketplace Services you are not allowed to use the Arya Marketplace platform.
your use of Arya Marketplace will not violate any applicable laws and regulations applicable to you, including but not limited to regulations on anti-money laundering, anti-corruption, and counter-terrorist financing.

‌Registration and account:

You may not register with our Arya Marketplaceplatform if you are under the age of 18 years. By using Arya Marketplace, agreeing to these general terms and conditions you warrant and represent to us that you are at least 18 years of age.;
Arya Marketplace collects and processes users’ personal data. For further details, every user is encouraged to read the Platform’s “Privacy Policy”. For the avoidance of doubt, with the exception of our payment provider, Identity Verification Provider, the Logistics Provider, and Financial Institution for Credit Purposes, we do not share your details with any other third parties.
If you register for an account with our Arya Marketplace, you will be asked to provide full name, email address, telephone number, delivery address. A one-time password will be provided to the User upon signing up. It is at this point that you are required to tick a box to confirm to agree with our terms of use and privacy policy.
1. You are solely responsible for keeping your login details confidential and must not disclose or share it with anyone. You will be responsible for all activities and orders that take place using your login information.
2. Notify us in writing immediately if you become aware of any disclosure of your password; and
3. You agree to be responsible for any activity on our menu list arising out of any failure to keep your password confidential and that you may be held liable for any losses arising out of such a failure.
Your account shall be used exclusively by you and you shall not transfer your account to any third party. If you authorize any third party to manage your account on your behalf this shall be at your own risk.
You hereby agree that you are responsible for maintaining adequate confidentiality and control of any and all credentials that you use to access the Smart Manu Platform.
You acknowledge that Arya Marketplace shall not in any way be liable for any loss, damage or costs caused by authorized or unauthorized use of your Arya Marketplace user account credentials.
We will never request for your credentials via email, SMS or any other means. If you receive such communication, please disregard and contact us
We may suspend or cancel your account and/or edit your account details at any time in our sole discretion and without notice or explanation providing that if we cancel any services you have paid for but not received and you have not breached these general terms and conditions, we will refund you in respect of the same.
Where we have reason to suspect or believe that there has or is likely to be a security breach or other misuse of our Platform, we reserve the right to require you to change your password. Failure to do so may result in us suspending or deleting your account.
You may cancel your account on our platform by contacting usin which case your details will be deleted from the Platform.
Once you create an account, you will be able to select items of your choice and order your items
As a user, you:
1. represent and understand that all account information provided is accurate, up to date, honest and not misleading;
2. commit to updating your account information as and when it changes; and
3. accept sole responsibility for any direct or indirect adverse consequences caused by the inaccuracy of this information or failure to update this information.
The information submitted to create or update an account constitutes a proof of your identity. We reserve the right to verify, at any time the accuracy of the information provided and to ask you for any additional documentation for the purpose of identity verification.

‌Accessing our Platform and the Services

We do not guarantee that our Platforms or any of the Services, will always be available, uninterrupted or fault free. We will not be liable to any user of the Platform if for any reason the Platform is unavailable at any time or for any period.
We do not guarantee that our Platform or any content on it will be free from errors or omissions.
You are responsible for making all arrangements necessary to have access to our Platforms and for ensuring that all persons who access the Platform through your user profile are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

‌Data confidentiality and security:

Arya Marketplace Implement strong security measures to protect user data and ensure compliance with privacy regulations.
You must provide us with correct and updated Personal Information including –identity data, identity documents, transaction data, and technical data. Your Personal Information shall be properly protected and kept confidential at all times.
We may use, process, store and transfer your Personal Information in order to –
1. provide Arya Marketplace Services, communications, and Customer services to you;
2. comply with applicable laws and regulatory requirements;
3. secure your Arya Marketplace user account and maintain data and information security;
4. verify the identity details and bank account details which you provide to us;
5. protect our vital interests and that of others;
6. facilitate corporate reorganizations; and implement direct marketing campaigns.
The developer for Arya Marketplace ensures the security and protection of its customers’ data and uses proper procedures and safety standards in collecting, preserving and dealing with data against unauthorized dealing. This encompasses all stages of data handling, from collection and preservation to processing and disposal.
Arya Marketplace is committed not to sell, rent or trade the data of its customers from the users of the system. Knowing that Arya Marketplace may use a third party to help it implement its business and improve service quality.
The data is not shared with any official government agency except by an official letter addressed to the company for data disclosures in security and criminal cases.
Buyers agree to processing of their personal data in accordance with the terms of Arya Marketplace Privacy and Cookie Notice.
Arya Marketplace shall process all personal data obtained through the marketplace and related services in accordance with the terms of our Privacy and Cookie Notice and Privacy Policy.
Sellers shall be directly responsible to buyers for any misuse of their personal data and Arya Marketplace shall bear no liability to buyers in respect of any misuse by sellers of their personal data.

‌Payments

You must make payments in accordance with the Payments Information and Guidelines on the Arya Marketplace.
Customers are able to pay online via card, transfers, with cash, POS systems or any other acceptable mode of payment as may be authorized by Arya Marketplace.
All payments made on our Platform are processed by a third-party payment processor which provides a gateway for online payments.
The payment processor is solely responsible for all payment transactions consummated on our Platform.
The sale prices of Products are displayed on the products offered. They are given in Naira for buyers within Nigeria and include any applicable taxes. Note that the platform automatically shows the price with currency depending on the buyer’s region. However, on check out collection the price will be in USD for all transactions outside of Nigeria.
The delivery fee can be accessed at the checkout page.
The total price is stated in the offer at checkout and is due for payment when the order is placed.
‌By creating an account, you agree to be bound by these terms of payment Returns and refunds

While making a bill payment transaction to a third-party merchant using Arya Marketplace platform, if you input an incorrect amount or reference number you cannot rectify or reverse the completed transaction on the Platform.
Arya Marketplace shall not be obliged to make a refund or amend the erroneous transaction. You must directly contact the third-party merchant for any refund, rectification or reversal of such erroneous transaction.
Returns of products by buyers and acceptance of returned products by sellers shall be managed by us in accordance with the returns page on the marketplace as may be amended from time to

time. Acceptance of returns shall be in our discretion subject to compliance with applicable laws of the territory.
Refunds in respect of returned products shall be managed in accordance with the refunds page on the marketplace as may be amended from time to time. Our rules on refunds shall be exercised in our discretion subject to applicable laws of the territory. We may offer refunds in our discretion:
1. in respect of the product price;
2. local and/or international shipping fees (as stated on the refunds page) and by way of store credits vouchers mobile money transfer bank transfers or such other methods as we may determine from time to time.
Returned products shall be accepted and refunds issued by Arya Marketplace acting for and on behalf of the seller. Notwithstanding paragraphs 4.1 and 4.2 above in respect of digital products or services Arya Marketplace shall issue refunds in respect of failures in delivery only. Refunds of payment for such products for any other reasons shall be subject to the seller’s terms and conditions of sale.
Changes to our returns page or refunds page shall be effective in respect of all purchases made from the date of publication of the change on our website.

‌Escrow Payments Clause

Escrow Arrangement

Arya Marketplace (“Platform”) provides an escrow payment service to facilitate secure transactions between Buyers and Sellers. Upon a Buyer’s payment for a product or service through the Platform, the funds will be held in escrow by Arya Marketplace or its designated payment processor (“Escrow Account”).
Release of Funds to Seller

Funds held in escrow will be released to the Seller under the following conditions:
- The Buyer confirms receipt of the purchased item in satisfactory condition via the Arya Marketplace app or website, or
- The return window expires without the Buyer initiating a return or filing a dispute in accordance with Arya Marketplace’s Return and Refund Policy.
  
  If a dispute or return is initiated, funds shall be held in escrow until the resolution process is completed and the appropriate party is determined.
Commission to Agents

Arya Marketplace supports commission-based participation. Agents who manage Buyers or Sellers may be entitled to a commission on completed transactions. Upon successful release of funds to a Seller, applicable commission payments shall be calculated and disbursed by the Platform to the entitled Agent(s), in accordance with Arya Marketplace’s Agent Commission Policy.
Handling Disputes

In the event of a dispute between a Buyer and Seller regarding delivery or product satisfaction, Arya Marketplace will retain the escrowed funds until the dispute is resolved through internal resolution mechanisms or external arbitration if required.
No Interest and Non-Fiduciary Role

Funds held in escrow do not accrue interest for any party. Arya Marketplace acts as a neutral holder of funds and does not act as a fiduciary or assume liability beyond its role as a facilitator under this clause.
Modifications

Arya Marketplace reserves the right to amend this Escrow Payments Clause as necessary to comply with changes in applicable law or to improve the efficiency and fairness of the transaction process. Notice of material changes will be communicated through the Platform.

‌Rules about your content

In these terms and conditions, "your content" refers to: a. All works and materials (including but not limited to text, graphics, images, audio, video, audiovisual materials, scripts, software, and files) that you upload to us or our marketplace for storage, publication, processing, or further transmission; and b. All communications on the marketplace, including product reviews, feedback, and comments.
Your content and our use of it, as outlined in these terms and conditions, must be accurate, complete, and truthful.
Your content must be appropriate and civil, and must not: a. Be offensive, obscene, indecent, pornographic, lewd, suggestive, or sexually explicit; b. Depict violence in an explicit, graphic, or gratuitous manner; c. Be blasphemous or violate racial or religious hatred or discrimination laws; d. Be deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory, or inflammatory; e. Cause unnecessary annoyance, inconvenience, or anxiety to any person; f. Constitute spam.
Your content must not be illegal, unlawful, or infringe upon anyone's legal rights, nor should it potentially result in legal action against any person, in any jurisdiction, or under any applicable law.
Your content must not violate or infringe upon: a. Any copyright, moral right, database right, trademark right, design right, passing off, or any other intellectual property right; b. Any right to confidentiality, privacy, or rights under data protection laws; c. Any contractual obligations owed to any person; d. Any court order.
You may not use our marketplace to link to any website or page containing material that, if posted on our marketplace, would violate these terms and conditions.
You must not submit any material to our marketplace that has been, or is the subject of, any threatened or actual legal action or similar complaint.
The marketplace review feature is intended for product feedback. You may not use it, or any other communication method, to post inaccurate, inauthentic, or fake reviews.
You must not interfere with transactions by: a. Contacting another user to buy or sell an item listed on the marketplace outside the platform; b. Communicating with a user involved in an active or completed transaction to discourage them from engaging with a particular buyer, seller, or item; c. Contacting another user with the intent to collect payments.
You acknowledge that all users of the marketplace are solely responsible for their interactions with other users and agree to exercise caution and good judgment when communicating with others. You must not share personal information, including credit card details.
We reserve the right to periodically review your content and remove any content, at our discretion, for any reason.

‌Our rights to use your content

You grant to us a worldwide irrevocable non-exclusive royalty-free license to use reproduce store adapt publish translate and distribute your content on our marketplace and across our marketing channels and any existing or future media.
You grant to us the right to sub-license the rights licensed in this section
You grant to us the right to bring an action for infringement of the rights licensed in this section
You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.
Without prejudice to our other rights under these general terms and conditions if you breach our rules on content in any way or if we reasonably suspect that you have breached our rules on content, we may delete unpublish or edit any or all of your content.

‌Use of Arya Marketplace website and mobile applications

The words “marketplace” and website” in this section shall be used interchangeably to refer to Arya Marketplace websites and mobile applications.
You may:
1. view pages from our website in a web browser;
2. print pages from our website for your own personal and non-commercial use providing that such printing is not systematic or excessive;
3. use our marketplace services by means of a web browser subject to the other provisions of these general terms and conditions.
You may only use our website for your own personal and business purposes in respect of selling or purchasing products on the marketplace.
Except as expressly permitted by these general terms and conditions you must not edit or otherwise modify any material on our website.
Unless you own or control the relevant rights in the material you must not:
1. republish material from our website (including republication on another website);
2. sell rent or sub-license material from our website;
3. show any material from our website in public;
4. exploit material from our website for a commercial purpose; or
5. redistribute material from our website.
6. Notwithstanding the above you may forward links to products on our website and redistribute our newsletter and promotional materials in print and electronic form to any person.
We reserve the right to suspend or restrict access to our website to areas of our website and/or to functionality upon our website. We may for example suspend access to the website during server maintenance or when we update the website. You must not circumvent or bypass or attempt to circumvent or bypass any access restriction measures on the website.

‌Delivery Services

Ensure seamless integration with local delivery services for order fulfillment.
The delivery of your products is executed directly between you and Arya Marketplace. The buyer will be given options of various logistics providers for the delivery of goods. This allows the buyer to choose a provider that best meets their needs in terms of cost, speed, reliability, and other factors.
You commit to taking delivery of the products you have ordered through the Platform.
If you do not receive all the items from your order, you must contact Arya Marketplace customer service immediately. In such cases, any missing items will either be delivered to you or, where appropriate, you will receive a refund for the undelivered items.
Users expressly accept that they are not able to ask for a refund or a later delivery of orders which they have made but failed to take delivery.
It is your responsibility to confirm delivery details and to ensure that the details provided including your address and phone number are accurate.
In the case of inaccurate or mixed up of orders, you agree to contact Arya Marketplace immediately and request for a return. The order should remain as delivered and not tampered with such that it becomes impracticable to bring it back to the form in which it was delivered.

‌Limitation of Liability

Nothing in these terms of use excludes or limits our liability for personal injury arising from our negligence or fraudulent misrepresentation or any other liability that cannot be excluded or limited by Nigerian law.
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may otherwise apply to our Platform or any content on it, whether express or implied.
We assume no responsibility for the content of websites linked to our Platform. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
As a user, please note that we only provide our Platform for domestic and private use. You agree not to use our Platform for any commercial or business purposes without a written unequivocal consent and we have no liability to you for any loss of profit or loss of business opportunity.
To the extent permitted by the law, Arya Marketplace shall not be liable to you for any indirect punitive, incidental, special or exemplary damages arising out of your inability to use our Services.
We are not liable for any damage which may be incurred by you from unauthorized use of, tampering or access to your Arya Marketplace account.
Arya Marketplace is not liable and you agree not to hold Arya Marketplaceliable for any damages or losses resulting either directly or indirectly from:
1. delays or disruptions in our Services, software, and Platform;
2. your use or inability to use or access our Services or Platform;
3. a suspension or other actions taken with your Arya Marketplace account;
4. any access or use of our services in a manner that is inconsistent with these terms of use or any error, inaccuracies, losses or omissions in or to any data provided to us; and
5. any damage caused by a virus or other technologically harmful material that may infect your electronic devices due to the use of our Platform or any website linked to it.
6. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable arising in connection with use of or inability to use our Platform.

‌Indemnification

You agree to indemnify, defend and hold Arya Marketplace Solution harmless against any loss, damage, liability and claim due to or arising out of your:
1. Use or misuse of our Services; and
2. breach of these terms of use or any applicable law.
We reserve the right at your expense to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

‌Restricted Activities

Our Platform must be used only for lawful purposes. You must not, and must not allow another person to use it for any purpose other than which we made it available.
As a user of our Services and Platform, you agree not to use them:
1. in a way that breaches the provision of any applicable law or regulation;
2. in a way that is not authorized by us or detrimental to us;
3. for any unethical, unlawful, fraudulent purpose or act (Including provision of false identification); and
4. to modify, adapt, decipher, disassemble or reverse engineer any of the software making up a part of our Platform.
5. hack or otherwise tamper with our website;

7. impose an unreasonably large load on our website resources (including bandwidth storage capacity and processing capacity);

By accessing and using our Services, you consent to receiving electronic communications, and that all notices, disclosures and other communications we provide to you electronically through emails or displayed on our Platform satisfy any legal requirement for written communications
You agree to the use of electronic signatures, contracts, orders and other records and to electronic delivery of records of transactions initiated or completed by you. You waive the rights or requirements of any law in any jurisdictions which require original signature, or delivery or retention of non-electronic records

‌Promotional Codes

Arya Marketplace may at its sole discretion, create promotional codes that may be redeemed for purchase discount, or other features or benefits related to the Services, subject to any additional terms that Arya Marketplace establishes on a per promotional code basis (“Promo Codes”).You agree that Promo Codes:
1. must be used for the intended purpose, and in a lawful manner;
2. may not be duplicated, sold or transferred in any manner, or made available to the general public (whether posted to a public form or otherwise);
3. may be disabled by Arya Marketplace at any time for any reason without liability to Arya Marketplace;
4. may only be used pursuant to the specific terms that Arya Marketplaceestablishes for such Promo Code;
5. are not valid for cash; and
6. may expire prior to your use.

Arya Marketplace reserves the right to withhold or deduct credits or other features or benefits obtained through the use of Promo Codes by you or any other user in the event that Arya Marketplace determines or believes that the use or redemption of the Promo Code was in error, fraudulent, illegal, or in violation of the applicable Promo Code terms or these Terms

‌Severability

If any of these terms of use are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by Nigerian law.

‌Sanctions of Breaches
In the event of any fraud, breach of these terms of use or violation of applicable laws or regulations, we reserve the right to take any appropriate measure, including without limitation:
suspending or terminating access to all or part of the services of the user who committed the breach; or
alerting all relevant authorities and taking legal action.
Any suspension or termination shall take full effect on the date we send the communication to the user and the user’s account will be automatically deleted without further notice.

The images of the products listed on our Platform may be stock photographs used by us for illustrative purposes only. Although we will make every effort to be as accurate as possible.
The order page and our communications to you in relation to any order will be in English. The order page will allow you to make your order, review your order and make any corrections before confirmation.

In addition, Arya Marketplace makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability or availability of the Services or any services or goods requested through the use of the Services, or that the Services will be uninterrupted or error- free. You agree that the entire risk arising out of your use of the Services, and any service or good requested in connection with it, remains solely with you, to the maximum extent permitted under applicable law.
Arya Marketplace will not be liable for any inappropriate or inaccurate use of product names on this Platform. Kindly contact us if you believe an item has been wrongly described and we will immediately take steps to remedy the same.

The invalidity of any provision does not affect the provisions of user conditions that lie on the rest of the correctness of the other provisions contained in this Convention.
